Sellers Liable for Disclosure Failure
Brokers aren’t liable for a seller’s failure to provide the buyers with a property condition disclosure form, a Nebraska appellate court has ruled. The court held that buyers could bring a lawsuit even if they closed the sale with knowledge of the property defect as long as they never received seller disclosure. Brokers are liable only if they knew that the sellers intentionally included false information on a disclosure form.
